Preparing the Habeus Corpus

These are my thoughts this evening as I prepare to draft my habeus corpus. I do not know where this will be filed . . . Part of it will be filed with Clark County Nevada, and perhaps part of it will be filed in the United States District Court (under the 9th Circuit Court of Appeals) . . .

Because "I keep on wondering why. I just keep wondering why." Why is this happening? Common law is based on common courtesy. Common courtesy is the preface upon which all civilized men and women base their relationships. Innate in common courtesy is the assumption that the other person is equal to you. Equal in the amount of forgiveness, respect, intelligence, etc. Knowing that at our deepest intention is the protection and preservation of our freedoms, birthright, children and our community, I keep wondering why. To uphold the intention of our founding fathers, as they wrote the Constitution requires the individual to wear the coat of position outlined in our documents leading up to the final and operating version of the Constitution. All laws must be taken in the context of the individual and the way they conduct their own personal matters and affairs. What IS their intent not what you FEAR is their intent or thought. The presumption of innocence is a high charge if this Union is going to be perfected.

If the intention to commit a "crime" does not exist, it must be dismissed.

My question is: "Will someone please show me the Court Rule that says I must have a driver's license or other form of picture I.D. to show the Court I am me?"

I am familiar with the basics of law. I know my way around a law library. I am familiar with the Clark County Law Library. There I inquired where to find the "Court Rules" for the court I visited. I checked all the rules, actually. At least everything I could think of to look-up that may contain a rule such as the one proposed by the Court. I'm a reasonable person of reasonable intelligence and I could not find a single reason why the court personnel had the right to NOT ADMIT me to appear before one of our generous public servants, especially one who is familiar with me, and can vouch for me. We cannot appear before our courts as person to person, since we are equal and we must allow the space for that kind of intimate, one-on-one dialog, face to face. That's what's biblical, that's what's right, that's what's democratic.

Criminalized America

and, perhaps i'm very, very naive still, but when did all common sense leave our planet? or is it we have just replaced it with common corruption?

i'm 41 years old. i've lived my entire life here on planet earth in several different states of the united states. i'm reasonably intelligent, some would say brighter than average, i am a mom, a wife, really a rather ordinary person. if i am compelled, i will pull over on the side of the freeway to see if they need help; if i see someone struggling with something, i offer to help; if i see something not right, i try to change it; i turn things i find to the lost and found.

am i so strange? and, the thought i am pondering right now is, in doing these things i was taught as a child and practiced my entire life, do they now make me a criminal?

here in america, that question doesn't even matter anymore. because the truth is, everyone is a criminal. everyone is either really and truly criminal ... messrs. bush and cheney come to mind ... and everyone else is merely labeled as a "criminal" by those with the authority and desire to define, label and designate someone else as such. and, if you think there is no possible way that you could be defined as a "criminal," i would smile and say, but you already are.

much like the way we designate who is and isn't a 'terrorist' or a 'rebel' (remember, nelson mandela was just last month undesignated as a 'terrorist'); "criminal" is a label in our everyday life that label makers apply liberally ... as you can see from the volumes of statutes logged on the books. i would argue that merely by being a reader of this can make you a criminal because you do not necessarily buy-in to the label maker's point of view and that is enough. and, you will find, that those who do find themselves subjected to the system, reveal the truth of their 'criminal mind' as most criminals are very easily made to comply, once their freedoms are threatened or stripped from their lives. their guilt is for the crime only they know they commit: self-denial.

today, in "the movement" (if you can call it that), everyone plays the game of the label-makers ... protesters arranging their arrests because they know how they've been labeled and can arrange their life to accommodate the role and its requisite duties established by their life's chore. they are criminals (though not guilty of harm), as they play in the game the label-makers create and they choose to partake in the give-and-take. clearly, dr. king was a criminal and would be today, because he played in their game ... knowing he did so to become a label-maker himself and redraft the laws to reform the books on the shelf.

but was rosa parks a criminal?

rosa parks wasn't a criminal ... and she lacked the "criminal's mind." she was, however, an individual who committed the biggest, most offensive human crime imaginable: she stood (or rather sat) in her individuality. and that, my friends, remains the crime we are all potentially guilty of as we close out this picean age or, in the language i was first taught, during this time of armageddon. it is the only crime for which true innocence is the defense. AND, if you so choose to energize this potential, if you find yourself involved with the courts like ms. parks, your only real crime is the one of not being engaged in their game.

in this chaos the churning transformation creates, criminals will emerge. we see those who do so in the light of day without accountability (merely because the collective is so, well, let's face it, most people are 'marks'); and then there those who do so in the light of the local news or in the silence thereof. for criminals are:

those who consider themselves equal in their being to the person standing right there or to the so-called collective's voice amplified in the statutes that are written by the label-maker's hand.

those who do their lives according to their own inner guide, experience and wisdom ... not to hurt anyone else, but to merely be who they are in the conscience and conscious application of their life without fear or even awareness of any consequences of the game maintain by those who claim they are "greater than" you.

i suppose then, perhaps maybe i am a criminal, then. the grand jury is right, as they have the authority to so designate me as such without even seeing my face or knowing who i am. there is no 'innocent until proven guilty' and our system is ill. but so am i, as i have been told, for being me, as smart as i am and still not developing a "criminal's mind" in this day and time.

as for sources for information ...

if you haven't checked out some of the bulletins i've posted recently on MySpace, do that (only if you want to see some of the things i've seen recently ... outside of the yahoo! news headlines when i sign on ... i think I reposted a bulletin with a newsclip from an interview with ex-Mex President Fox from some years back ... if its not there let me know, i'll find it and repost it).

but, to be honest, you don't have to look at "alternative" web sources to see what's happening, traditional, mainstream sources like PBS, NPR and even to a much lesser degree, the other mainstream media contain all the information, you just have to see it. i think the big key is to listen to the news ... discern the difference between news and opinion (which is hard to do right now in our current information market). my personal favorite person in the news market is bill moyers, i try to catch his show on pbs at least once every couple of months to know i'm not insane and that there is hope here in america!

if you want to really know what is happening, less is more.

it is about increasing YOUR awareness ... which, i am sure you have learned, you cannot do if you are being fed other people's awareness (the whole "ask, seek & knock" rather than "sit and be told"). you know the trick, find and know your sources ... the one's that increase your awareness and encourage you to ask more questions rather than think they've answered them for you.

what is happening is all being done in "plain view" ... there's no real way to hide it, but they definitely do a good job using the information market to make it appear exactly how they want it to in order to achieve their goals ... emotional people don't make good decisions. people who are about making money (at least right now in this greed economy) feed off people making bad decisions ... and america is all about the emotions ... but i'm sure you don't want to get into an astrological discussion!

ah, but your question ... my take on the bailout ....

first, you can't just look at the bail out ... you have to see what the fed has been doing with the dollar over the past years (since the "outing" of the new world order agenda by GHWB). but in the past months, in particular, you can easily see a view of the larger picture. the influx of $s by the fed into the foreign banks in september was very interesting. also, look at all of the other "bailouts" already conducted and see who did it, e.g., was it the fed, the treasury, or FDIC? see what they got for their "investment" and who benefits vs. the current bailout. watch the banking consolidations too! you also have to pay attention to the controversy relating to the number of $s the fed is printing right now, coupled with the other controversy of the fed NOT disclosing to the global markets the actual number of dollars currently in and now being put into circulation.

in terms of america and the bailout, i think that www.wethepeoplefoundation.org, is really the only sane website looking at the bailout from a constitutional point of view.

the bailout is fundamentally anti-american, but we don't want to think about that because we have so much invested in this false america ... that is how so many other empires have fell before, this is nothing new. everyone else is yakking about it on a very superficial level ('omg, what about jobs?" ... as if this whole thing doesn't come down, you're not going to do what you need to survive ... and one really needs very little to survive!). i think those who were offering alternatives to the bailout scheme, were basically offering the same net effect of the bailout ... still they are only doing so because they do not want to detach from the illusion. i think that some of the alternatives that were offered were a more practical, easier pill to swallow, and definitely better for the every-day man, but, come on, if it was about america or the man in the street, we would have never elected GWB once, let alone twice ... and/or let him get away with all of the executive orders he put in place, AND we would have tried him for treason already!

then, you also have to watch the oils futures market and see how its dropping ... the oil market is based on the dollar (why? who the hell knows (actually, that's a very interesting thing, but a can of worms i'm not going into at 4 a.m.!), but it is, and they want to change that, and have wanted to change that for a long time!) bear (pun intended) in mind, russia is a huge player in this. china is the largest player, but they are pretty content to watch the game occur between those who are manipulating, posturing and, well, scrambling. china will play the game from a tactical point of view that is detached from the actual movement, capitalizing on the moves being made rather than being a major "player" in the movement. for me, that is true capitalism, and the way you have the most power and favorable outcome because you capitalize on every twist and turn of others who think they are controlling everything -- then you can create fortune on every movement.

the bailout is part of the process we are in: the collapsing of the dollar. it is a necessary step for the switch to the amero. the contracts and treaties are already in place for the amero, lou dobbs is about the only mainstream media person even trying to watch this transpire, and they have shut him down pretty consistently on this issue. i have heard more talk about it on the "infomercial" news stations recently, so they are really starting to focus on the shift.

so, the dollar is collapsing, no big deal, really, if you are smart about it. likely, they will first 'revalue' it, a popular way for those who are in the know to make some quick cash ... if you study recent currency collapses/revalue and/or conversions in europe (to the euro), and look to the mexican, central/south american markets or japan for currency revaluation, you can see how that game is played.

personally, i think the bailout may have saved the '08 election. i think that if the bailout did not go through congress, steps would have been take to institute the executive orders that have been put in place and the election would have been suspended for any number of reasons that could be used right now. the bailout was definitely a ploy to make sure that everyone is going down the same road together ... everyone involved in politics is committed to the 'corporate america', and further confirmation of the movement to the "one world order" (and i don't think that is a bad word or phrase, its just what is happening). that "order' can be created however those who are aware want to create it ... unfortunately, i think that right now, those who are aware and creating the structures right now for this new world order are not very community minded and could give less than a hoot about anyone but making money. but, i no longer have the feeling that the elections are not going to happen ... a strong feeling i've had for the past 9 months.

its fun watching the jockeying for position ... for instance, i love what the new president in france is doing right now outside of the G7 organization ... that's really intriguing. the asian markets dropping tonight, i haven't looked into that yet, but i suspect some of the asian nations will follow the europeans and have a similar pow-wow, the question is are they going to do it within their 'nwo' organization ... asiana (?? or something like that), or separately? ... and then there's africa ... what's happening there is so transparent!

yep ... i know. america is gone. the coffin has been lowered and the bull dozers are on their way to return mother earth's soil to bury that which we killed or let die.

they don't use shovels anymore to put the dirt back, they use bull dozers. its much faster that way. so ... you want to really create america the way it was supposed to be made?

non-violently?

equally?

honorably?

you see ... because even while the principle was "all men had the right to life", our founding fathers and the founders of america didn't really believe that. those men that king george and england paid/enslaved to come to america to fight to "preserve the kingdom" did not deserve to die. our nation was built on a truth that they did not believe was true. and they used violence and killing to build something that is supposed to believe that "all men have the right to life."

ghandi freed his nation without war. without violence ... he liberated and freed india from the same kingdom who colonized america. america used violence and the death of many men to achieve the same end.

he did not have a document that said "all men have the right to life" ... he just honored that principle and fought for and won his nation's freedom and liberty through the honoring of that principle.

tomorrow, 17 march 2007, is my mom's birthday, and while she claims she "doesn't understand me", i know she lies.

The final grievance ...

well, its done ... mr. bush has now enacted every cause listed in our declaration of independence.

My first entry on this blog, I wrote my own Declaration of Independence based on the original one signed by the founders of the "united states of america" ... at that time there was only ONE of the grievances the founders listed against King George of England why they decided to they had no choice but to declare their sovereignty and independence from King George and England, that was not a grievance that could be made by the people against the executive branch of the United States of America its "President" George (Bush) ...

"He has obstructed the Administration of Justice, by refusing his Assent to Laws for establishing Judiciary powers.

He has made Judges dependent on his Will alone, for the tenure of their offices, and the amount and payment of their salaries.

He has erected a multitude of New Offices, and sent hither swarms of Officers to harass our people, and eat out their substance."

SOUND FAMILIAR!???!?!?!?

Did you read the headlines today? ... CLICK HERE ... That is one version of the story found on Yahoo! News. For those of you who were not paying attention in class during Civics or Government, Mr. Bush and his administration just fired 8 United States Attorneys ... those are the attorneys that are supposed to represent the people of the United States of America ... those were our attorneys he just fired for his own reasons and agenda.

Ok, so "president" Bush's tactic is a bit different than that of King George, because as I pointed out before, that perhaps the ONLY reason why he had not made "Judges dependent on his will alone" ... was that he COULD NOT ... no matter how much he didn't like Justice Stephen Reinhardt or the other members of the 9th Circuit Court of Appeals, Mr. Bush would have to kill them to remove them from office if they did not voluntarily resign from or die on the bench.

So, the next best thing ... how else to get a justice system to work for you if you cannot completely rig the bench ... rig the prosecution, of course. What cases will be brought up for the people of the United States will be completely determined by the Executive Branch of the Federal Government. Does anyone else see this how I see it? Are any of the other "people" of the united states of america paying attention to what has happened this week?

This week, Mr. Bush has finally and completely through executive order and executive order and executive order put in place every single grievance that was the reason for the formation of this nation by our founders, in the form of the executive branch of the federal government.

That's not enough for you to at least pick up a sign and stand up for your rights? for your nation? for the independence of america once again. our founders had to pick up guns to fight for this, we merely have to pick up protest signs, inform one another and get in the street. Our Congress can get rid of Mr. Bush through impeachment ... if they have the motivation to do so. The people must be the motivation ... they will NOT do it, if we do not motivate the change.

We can do this without violence where our founders could not ... but we must do it. YOU must be a part of it, YOU must fight for your country.

March 17, 2007 ... there are "protests" throughout the world ... THINK OF ME AS PAUL REVERE ... the "Bushies" are coming, the "Bushies" are coming ... they do not have a nation, they do not honor america, they act and impose the things this nation was founded to stand against. ... CLICK HERE ... TO READ the DECLARATION OF INDEPENDENCE ... REMIND yourself why you were born here, why you immigrated here, why you are alive today.

... because its time. Do not go to "protest" what is happening. Go to stand in energy of the Declaration of Independence on which you claim to be an american.

WHETHER YOU LIVE IN THE UNITED STATES OR NOT ... be an american ... CLAIM YOUR INDEPENDENCE TODAY. An "american" is not a citizen of a particular nation-state, it is state of being.

or don't, that's your choice. me, i'm an american and i don't need any more to prove to me that this administration needs to be removed immediately due to its detrimental impact to this human being and her future.

the beginning of WW III

i've been discussing that the beginning of world war 3 began when george bush i invaded iraq in the early 1990s ... well, that perhaps is wrong. because as the more i learned and the more i studied, i realized that all of our military actions prior to then were somehow all related to the rise of power of the united states ... and perhaps not the "united states of america" as originally created under our declaration and the original constitution ... but the 'united states' as it has become since the civil war.

i recently received a link to this presidential address by president eisenhower ... this is the beginning of world war 3 ... it is the world war of consciousness ... who controls the power ... this is our present war, and we are 46 years into the war ... whose ready to see the real war and stop it?

while i will be searching for a link to the entire speech, and well, the effects were a bit dramatic ... listen to the president's words carefully ... world war 3 is a global battle for peace ... those who would use violence and our resources and human spirit to bring violence on another person ... versus those who of us who would not. the innocent people involved in the actual battle ... whether economically or in the theater of war, are just that, the innocent victims.

question one: who are your innocent victims? do you support the structure that can perpetrate violence? those are your innocent victims.

question two: do you support the structure that refuses to perpetrate violence? your innocent victims are those who support the structures of question number one.

free will and choice ... "all men have the right to LIFE", do you have the choice to take that right away from someone else? if so, and the golden rule is true, so too does someone else have the right to make that choice for YOUR life.

it is in peace, tolerance and love is how we will heal.

pledge of allegiance

have you recited the 'pledge of allegiance' recently?

do you even recognize 'the Republic for which it stands'?

since we are currently part of a Republic that accepts as legitimate the 14th Amendment, the "Republic" for which it stands is the 'federal government.'

the pledge of allegiance to the "Republic" sacrifices the individual's sovereignty and in fact sacrifices the sovereignty of the state in favor of the federal branch of government.

if the citizens of the states do not fight for their individual sovereignty and the rights that should be retained by the states through the passage of federal legislation after federal legislation, the pledge of allegiance to this "Republic" is very unpatriotic and unamerican.

renew your principles and think about what you pledge your allegiance to ... make sure your words mean something.

the required recitation of the pledge of allegiance in school is unconstitutional on more than the grounds upheld by the 9th circuit court of appeals. to have school children forced to recite a pledge of their allegiance, which is something they cannot possibly understand until they are older, let alone pledge that allegiance to something that is actively stripping away their american birthright of individual sovereignty is wrong.

i love my nation, but i definitely do not pledge my allegiance to the 'republic for which it stands' as it now stands for something other than what is defined in the declaration of independence, the constitution through the bill of rights. so long as the 'republic' accepts as valid and "constitutional" the 14th amendment, this is not 'the republic for which it stands' to which my loyalties are pledge. my allegiance is to the republic that was built on the principles of individual sovereignty, freedom and liberty -- that is not the republic of today's america.

that this is the chance we wanted to actually do something about the direction of this nation ...

still believe that your vote doesn't count ?

i may not ... especially if you don't cast it.

still think you don't have to remind people that there's an election coming up?

'we the people' need help, so help your neighbor and strangers you meet to remember that this nation can once again be a nation of 'we the people' ... we can be patriotic and proud americans once again.

i vote, just in case it really does count.

i believe that if 'we the people' vote, we can change the direction of our nation.

i am curious, does this flag offend you?

our history books and teachers SUCK. for so many years, this flag was a flag of shame, and for most people in america it still is.

going back, as an adult, and learning about the civil war, the causes of it, what happened politically, legislatively and in reality, has been a wonderful journey ... although i am angry with my parents for not knowing the history of this nation, with my teachers and schools for not teaching me the truth, and for the emotional spin people who don't know the truth put on this flag in particular.

did you know, the north declared war? yes, the federal government, and the representatives of the remaining states declared war on the states that decided ... 'we do not consent to be governed by this government.'

do you remember this ... "That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, — That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness." - Declaration of Independence.

so, the north said, we don't care that you don't like our government, you can't leave ... you cannot choose who governs you. slavery was an issue of emotional charge ... much like terrorism is an issue of emotional charge.

and if the people of the state of south carolina could decide 'we do not consent to be governed by the united states of america on a federal level', then too so could the people of all the nation. and rather than reconcile the differences, they went to war to force a way of government on people without their consent ... or, at best through coerced consent.

today, we experience coerced consent each day of our lives in this nation.

look around at your life, and see the ways you do things because there's a law that you don't agree with, but that you follow just because if you don't, you will be penalized.

this was never supposed to be a nation of penalized people, yet we do it every day of our lives ... accept penalties and interferences with our daily lives to deal with those penalties ... to what end? so its easier later? its not going to get easier later ... consent must be given to how you are governed ... they assume you consent ... but you don't have to.

be an american ... live according to the government you consent to be governed by ... it is your right.

the battle flag of the south, when they were a sovereign nation, invaded by a nation that would seek to impose a form of government to which they did not consent.

I am currently researching the astrology of the Declaration of Independence, the Constitution as well as the acts taken by the Civil War Congress (the congress which convened after the southern states dissolved the original United States of America). If you don't care about America, that's fine, but I do. I want to know more, and I hope you do too.

These are some of the laws passed under the Civil War Congress:

1. Emancipation of the District of Columbia and the Civil Rights Act ... which turned "the people" into 'citizens' of the federal government ... this led to the "14th Amendment" which was questionably ratified ... which is currently the subject of the immigration debate we are currently engaged.

2. The Homestead Act ... the beginning of eminent domain

3. The National Bank Act (e.g., creation of the Federal Reserve Bank)

4. The Coin Act ("in God we trust" on money) ... the end of the separation of the church and state.

a letter to the president ...

... sometimes things happen that even piss my husband off (which takes quite a bit ... i should know!) ... this is a recent letter he wrote to our mr. bush in washington ....

Dear President Bush,

I am a resident of the United States of America, and a registered Republican in the state of California, and I have to say, I am thoroughly appalled at what I am reading in the press about this case involving the rape-murder of an Iraqi teenager and her family by US soldiers. Mr Bush, this case is another potential powder keg for your legacy, if you even care about it, given that the story was broken to the press by top ranking generals. The silence from the White House and Secretary of State's office is deafening. Why play the let's-just-wait-and-see game, Mr President?

If you haven't seen an account of what our military legal corps are alleging happened, here is some of what Yahoo news is reporting:

"The soldiers drank alcohol, abandoned their checkpoint, changed clothes to avoid detection and headed to the victims' house, about 200 meters (yards) from a U.S. checkpoint in the "Triangle of Death," a Sunni Arab area south of Baghdad known for its violence, the affidavit said.

The affidavit estimated the rape victim was about 25. But a doctor at the Mahmoudiya hospital gave her age as 14. He refused to be identified for fear of reprisals.

[Former soldier Steven D.] Green is accused of raping the woman and killing her and the three other family members, including a girl estimated to be 5 years old. An official familiar with the investigation told The Associated Press that Green set fire to the rape victim's body in an apparent cover-up attempt.

Iraqi authorities identified the rape victim as Abeer Qassim Hamza. The other victims were her father, Qassim Hamza; her mother, Fikhriya Taha; and her sister, Hadeel Qassim Hamza.

The March 12 attack was among the worst in a series of cases of U.S. troops accused of killing and abusing Iraqi civilians."

Let me remind you once again, Mr President (and who ever else is reading this), of the names of these Iraqi civilians who were in support of the American presence in their area to quell insurgent violence until 5 rapist-murderers in our US military snuffed out their lives:

Abeer Qassim Hamza (the targeted victim, 14 years of age). Her father, Qassim Hamza; her mother, Fikhriya Taha; and her sister, Hadeel Qassim Hamza (5 years old. One year younger than my American daughter!).

As a father, as an American, as a Christian, I am outraged to the point of violence myself. Just how do you think the enemy feels? Do you think this can be diplomatically handled or just shoved under the carpet by the Administration like so many other serious things that have occurred on your watch?

You call yourself a Christian man. You say you care about the people of Iraq. You say you care about the people of the United States of America, our safety and security against terrorist attacks. If even one of these statement are true, you must act boldly, Mr President. Our enemies are waiting to see just how you handle this situation. Thinking pragmatically, you have an image problem, Mr President. Many of my republican friends feel the White House does not give a damn about anything but itself. If this rings true, then act, Mr. Bush! Treat this heinous and deplorable incident as if the victims were Jenna, Barbara, or Laura. Tell the world that these cowardly, disgusting murderers, who have disgraced the uniform and brought shame on every American soldier who have given so much to our great nation, will be prosecuted to the fullest extent of the law. Call their hideous acts of decrepit decadence and moral bankruptcy for what they truly were: crimes against humanity. Get angry, Mr Bush! Get angry that this one foolish and sinful act has set back your agenda. Make sure every American and the world is crystal clear that justice means something in the United States of America.

Don't play the role of a lame duck, Mr President. You have the chance to get those in Iraq who may be on the fence to reject the path of insurgency by your remarks today. Those incredibly despicable individuals have threaten national security and endangered every American on planet Earth with their callous acts against a child, no doubt. Don't aid and abed this tyranny by remaining silent. Speak out, Mr President.

Think of what good you could do to restore public faith in our great Republican civic leaders with a strong stance on this issue now. Rape is a horrible, horrible act of cowardice and unthinkable violence. Don't let this opportunity escape you like Hurricane Katrina where the sluggish response from Washington admittedly appeared a day late and a dollar short. Be swift and decisive. Let the world know Americans are not rapists and murderers. In the eyes of those left behind, particularly the 8 and 13 year old orphaned brothers of this poor violated and fallen child, sister, daughter, niece, friend, human being, this is what America, Americans, and every American soldier serving overseas looks like. Don't make the mistake of thinking a bunch of court maneuverings and legalese will take these scorching memories away.

these were some reasons the founding fathers of our nation penned when they DECLARED THEIR INDEPENDENCE ... these were grievances against the then king of England, King George, which i adapted to the present day administration of the 'United States of America' ...

He has violated the Constitutional Laws of this Nation, those most wholesome and necessary for the public good.

He has forbidden CONGRESS to pass Laws of immediate and pressing importance, unless suspended in their operation till his Assent should be obtained; and when so suspended, he has utterly neglected to attend to them.

He has refused to pass other Laws for the accommodation of large districts of people and seeks to preclude classes of People from equal rights under the Laws, a right inestimable to them and formidable to tyrants only.

He uses all branches of the Federal Government for his own ends and to for the benefit of all People without prejudice, for the sole purpose of fatiguing the People and Congress into compliance with his measures.

He has issued more Executive Orders completely bypassing the House of Representatives and the Senate, never having to justify his invasions on the rights of the People.

He has eliminated the need for Congress and is acting without their consent on major issues; the States remaining in the mean time exposed to all the dangers of invasion from without, and convulsions within.

no war • no shame • i am a proud american

that was the slogan on my first anti-war poster. i lived in alhambra, california when 9/11 happened and we commenced the war in afghanistan and resumed the "theater" of war in iraq.

while living in alhambra, i met a neighbor, he was 72, his name was "Mr. Ray". if you saw mr. ray, you would have sworn he was a homeless bum, pushing his shopping cart of cans, hunched over from oesteroperosis, shufflin his feet, not able to pick them up completely, drool hanging from the corner of his mouth which housed only his tongue. the first time i met him, he was down the block, sitting on his chair on the sidewalk, socks and shoes off, and he was putting some cream on his feet. they were purple to black in color. later that week, i ended up bringing him to the VA to have his feet checked on ... diabetic, unless he changed, he was going to lose them. the only thing that made mr. ray take his insulin was mrs. ray (his wife, violet). if he could not walk, he would have to stay home with her ... he took his insulin.

what happened to him, i wondered, to make him this way. i eventually met his brother, a couple of years older than mr. ray ... perfectly normal, healthy ... a regular guy. i asked him what happened. "he was never the same since the war." 'the war' was the korean war in their case. mr. ray enlisted along with all of his brothers and was used by the navy on the docks down in long beach. he worked on the loading docks loading weapons, rations, supplies and the like onto the ships to carry off to the war. that didn't sound too bad to me, and no one, especially his family, could understand why the war affected him so much.

if the war didn't happen and mr. ray at the age of 18 did not enlist, he would have probably have been a poet, an artist, a mathematician (what he could figure out in numbers in his head was amazing). i once asked him about the war, and what happened, he would just sob uncontrollably. its was probably two years after i met mr. ray that he had an accident and ended up at the VA hospital in west los angeles. i would go and visit and he was doing great ... recuperating quite well. i had not seen mr. ray look as good as he did while he was there. of course, they were taking care of him, making sure he was taking all of his medications (which i learned included many 'psychological' drugs) ... his chronic depression gone, we were able to sit in the park surrounding the hospital and talk about the war.

he told me about one day, he was loading stuff like always and a box of grenades had dropped, broken open and they were working to clean it up, repack it and load it up to go. not that big of a deal except that was the first time he had ever held a grenade, a mini-bomb he called it. so long as they were in boxes and things, the word on the outside of the box meant little to him. now that he held "the little bomb," he had a huge realization what he was doing. he knew that the only purpose for that 'little bomb" was to kill someone. he didn't even know why they were fighting the war. he said that every box he now loaded was a box intended for the sole purpose of killing another person.

mr. ray was the youngest in his family ... he had no reason to kill anyone. he wasn't a fighter, as his brother told me, he was the only one in the family (with 4 boys) that never got into 'fistocuffs' or trouble.

one day several months after his release from the hospital and mr. ray had stopped taking his medications, as he tended to do because he did not like how they made him feel, i found him, once again, sitting on his chair on the sidewalk about a block from his house sobbing. incoherent, the only words he would repeat was "i'm so ashamed, i didn't have to do it, elaine. i didn't have to do it. i am so ashamed. i killed so many people."

perhaps an unrealistic view from a man who carried so much shame for many years for what he saw as his part in the war, death and destruction in korea ... but he carried it nonetheless. one man, in the last "good" war, carrying the shame of killing people he never knew for reasons he didn't even know why.

no war • no shame • i am a proud american ... because if he wasn't taken so young in his life to become a part of our nation's war, mr. ray would have had a perfectly normal life. and he stayed right here in his home town of long beach, california.

Reason No. 4 ... blame the fruit, not the tree

so, didn't everyone know that war ... using bombs and guns and things like that would murder innocent people, thereby violating one of the key principles of our nation. you remember the one, that '... all men have been endowed by their creator with certain inalienable rights, among these are the right to life ...."

anyway ... something i thought about when i read this Yahoo! Headline

U.S. troops to get ethics training in Iraq "BAGHDAD, Iraq - The top U.S. general in Iraq on Thursday ordered American commanders to conduct core values training on moral and ethical standards on the battlefield."

so, while the military is calling for 'core values training on moral and ethical standards on the battlefield', shouldn't the commander-in-chief be trained in the core values of america? if that could happen, perhaps those under his command would be able to follow his leadership and values and morals and the murder of innocent people would have never happened.

and then i read this, and i thought about how many lies the president has already admitted, the scandal in the vice president's office, this report didn't surprise me at all.

Report: False testimony in Haditha probe "WASHINGTON - President Bush promised on Wednesday that any Marines involved in the alleged murders of Iraqi civilians will be punished. A senior officer said the case could undermine Iraqis' support for the presence of American troops."

honestly, is it surprising that the military under the command of Mr. Bush is producing 'false testimony'? and, why should they be punished if he, in authorizing the 'military operation' because we have never issued a declaration of war, be held accountable alone. and shouldn't the person who ordered the countless bombings that killed thousands of innocent iraqis be held accountable too?

with freedom comes the underlying imperative of personal responsibility. until our leaders take responsibility for what is going on, they will continue to harbor deception and destruction. hair splitting of what is 'morally justified murder' as the truth is revealed, is not strong leadership its shucking and jiving -- looking for others to take responsibility for the decisions and judgments made by our president, the self-proclaimed, 'decider.'

Reason No. 3 ... the U.S. government is violating our Constitution its principles in continuing the funding of the War in Afghanistan and Iraq and the sundry other places where we are instigating war against the people of the earth.

I wonder why if it was wrong for Hitler and Germany, why it isn't wrong for the United States and George Bush?

c - The "sovereignty" rule means that it is a crime of aggression to use armed force with intent to overthrow the government of a state or to impede its freedom to act unhindered, as it sees fit, throughout its jurisdiction.

This definition of the crime of aggression belongs to jus cogens, which is supreme in the hierarchy of international law and, therefore, it cannot be modified by, or give way to, any rule of international law but one of the same rank. An arguable example is any rule imposing a conflicting obligation to prevent, interdict or vindicate crimes which also belong to jus cogens, namely aggression itself, crimes against humanity, genocide, war crimes, slavery, torture and piracy, so that a war waged consistent with the aim of repressing any of these crimes might not be illegal where the crime comes within the limit of proportionality relative to war and its characteristic effects.

i'm a random blogger ... i like to click that 'next blog' button and see what the rest of the blogging world is talking about ... i found some interesting ones, funny ones, sweet ones, nonsense ones and 'useless' ones (the ones with pictures of models ... with their clothes on, no less). but i ran across this one ... Randomness with Enthusiasm after running across a "random" blog that linked me there because of googles' adsense rules ... since i was amused by the site and decided to check out its sponsor, i clicked on the "Hurricane Katrina Relief" banner ... being a good person in general, how can you help but support that????? WELLLLLLLLLL .....

REASON NO. 2 ... where money is going ....

so i click ... this is what i see ... a governmental agency under the control of President George Bush ... USA Freedom Corps ... created, you guessed it, by an executive order of the President of the United States -- no Congress needed to delegate the money being collected, the Executive Office is in complete control of this "governmental agency."

And, while writing this blog, i had to go back to pick up the link, so i clicked on it again ... and this is what i see ... Bush/Clinton Katrina Fund

I always thought the America Red Cross was a citizen-based agency that collected money and distributed it on programs they thought were best for the people of the world ... they are now a funnel of money of good will to whom ?

Am I the only one who sees a problem with this?

U.S. Citizenship For Sale ... What's For Sale ...

yes, as my initial post on this blog indicates, i am offering up for sale my citizenship in the United States of America ...

this will include, my social security number and all rights to my "citizenship" in the current nation-state of the United States of America. insofar as the citizenship is property of me, i believe i am entitled to sell it for profit or in trade to anyone i choose.

what this means ... and what exactly is for sale ... is as follows:

When South Carolina succeeded from the United States of America, as founded under the Declaration of Independence executed on July 4, 1776, and the subsequent Constitution of the United States of America executed on, ironically enough, September 17, 1787, ceased to exist. The withdrawal of the original states who formed the nation, rendered that nation-state experiment over. The United States of America ceased to exist ... but it didn't. Fast acting by the remaining states that then formed the new corporation called "The United States of America." The remaining representatives in Congress and President Lincoln passed some legislation and transformed the legal formation of the nation-state.

Of course, we know what happened -- the country got back together --- but what really, legally happened in the reformation of the new "United States of America"?

To be a citizen of the united states of america under the principles of our founding documents, you don't have to do anything ... you just have to claim your sovereignty and be an american. there were no forms to fill out, just proclaim, "i am a sovereign person, with no higher authority over me to exercise their will or ideas of being over me. i choose to consent to be governed under these circumstances." That is the design of the Declaration of Independence and the Constitution.

But, we are not currently living under the principles of that Declaration or that Constitution because those things were completely changed in the amendments to the Constitution passed AFTER the new formation of nation-state after the Civil War. Obviously, the current nation-state of the United States of America claims I am a Citizen (note the capital "C") and subjected to its laws, etc. But, I am not. The fact that I was born in the United States of America does not make me a Citizen without the rights of sovereignty, as stated in the founding documents of this nation; obviously, this feeling is much like the founding fathers of my country were not subjected to the rule of a king merely because they were born in Briton.

However, there is no 'new land' ... well, none yet. So I have to work with what reality is. OK. The nation-state claiming to be the United States of America still subscribes to the Declaration of Independence as its founding document, and the Constitution as its governing document. Insofar as the form of the Constitution of the United States until the first breach of its own rules, e.g., the failure to fully ratify an Amendment through its self-defined terms, all Amendments to the Constitution ratified after must be reconsidered based on a deceptive doctrine.

So, insofar as based on my happenstance birth in portland, oregon, and it being one of the states that comprise the United States of America, i have a 'Citizenship' based today, now exclusively based on my social security number. I did not agree to any terms or limitations when I received my social security card and my citizenship through inheritence of my parents, therefore, I believe I am entitled to sell it. As a friend wrote to me recently,

"If English royalty can sell their titles in the classified section of
'The New Yorker,' why can't you sell your citizenship? What party
line-toting Republic could object -- at least without losing their
laissez-faire cred (that's in the economic sphere. They seem to want
to get into our homes, our computers, our phones and even in your
uterus to a fare-thee-well)."

So, that's what's for sale. My inheritance: Citizen (capital "C") as used in the "operational" "Constitution" of the United States of America post 13th Amendment.

What I would consider in trade: A nice house with land for a garden, some goats and horses and a go-kart track, near the ocean.

you know what ... a part of me really wants to listen to what the president said today, but ... you know what? the headlines did me in, once again ...

"president orders 6000 troops to our borders" ... what ... i'm so afraid of my mexican neighbor now that i am placing an armed guard between our lawns?

mr. bush, YOU ARE A MEAN PERSON. I DO NOT LIKE PEOPLE WHO TREAT THEIR NEIGHBORS THAT WAY. I DO NOT TREAT MY NEIGHBORS THAT WAY. YOU NO LONGER REPRESENT ME.

AND, BASED ON THE DECLARATION OF INDEPENDENCE THAT FOUNDED THIS NATION, AS MODIFIED BY ME, I HEREBY INFORM YOU THAT:

When in the Course of human events, it becomes necessary for a PERSON to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

I hold these truths to be self-evident, that all BEINGS and PEOPLE are created equal, that they are endowed with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.

That to secure these rights, A PERSON JUST NEEDS TO EXIST. ONLY TO THE EXTENT WE NEED THEM, Governments are instituted among People, deriving their just powers from the consent of the governed ...

That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.

Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed.

But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.

Such has been the patient sufferance of this Person; and such is now the necessity which constrains them to alter my former Systems of Government. The history of the current president of the United States of America, GEORGE W. BUSH, is a history of repeated injuries and usurpations, all having in direct object the establishment of an absolute Tyranny and Terrorism over the entire planet.

To prove this, let Facts be submitted to a candid world.

He has violated the Constitutional Laws of this Nation, those most wholesome and necessary for the public good.

He has forbidden CONGRESS to pass Laws of immediate and pressing importance, unless suspended in their operation till his Assent should be obtained; and when so suspended, he has utterly neglected to attend to them.

He has refused to pass other Laws for the accommodation of large districts of people and seeks to preclude classes of People from equal rights under the Laws, a right inestimable to them and formidable to tyrants only.

He uses all branches of the Federal Government for his own ends and to for the benefit of all People without prejudice, for the sole purpose of fatiguing the People and Congress into compliance with his measures.

He has issued more Executive Orders completely bypassing the House of Representatives and the Senate, never having to justify his invasions on the rights of the People.

He has eliminated the need for Congress and is acting without their consent on major issues; the States remaining in the mean time exposed to all the dangers of invasion from without, and convulsions within.

He has endeavoured to prevent the population of these States; for that purpose obstructing the Laws for Naturalization of Foreigners; refusing to pass others to encourage their migrations hither, and raising the conditions of creating a second class of citizenry of People.

He may have obstructed the Administration of Justice by his appointments to the Supreme Court.

He has erected a multitude of New Offices, and sent hither swarms of Officers to harass our people, and eat out their substance.

He has kept among us, in times of peace, Standing Armies without the consent of our People.

He has affected to render the Military independent of and superior to the Civil power.

He has combined with others to subject us to a jurisdiction foreign to our constitution and unacknowledged by our laws; giving his Assent to their Acts of pretended Legislation:

For Quartering large bodies of armed troops among us:

For protecting them, by a mock Trial, from punishment for any Murders which they should commit on the Inhabitants of these States:

For cutting off our Trade with all parts of the world:

For imposing Taxes on us without our Consent:

For depriving us, in many cases, of the benefits of Trial by Jury:

For taking away our Rights, abolishing our most valuable Laws, and altering fundamentally the Forms of our Governments:

For ignoring our own Legislatures, and declaring themselves invested with power to legislate for us in all cases whatsoever.

He has abdicated Government here, by declaring us out of his Protection and waging War against us.

He has plundered our natural resources, made deals with large corporations to the detriment of our natural environment, allows medicines to be administered that is known to kill the People, ravaged our Coasts, burnt our towns, and destroyed the lives of our people.

He is at this time transporting large Armies of foreign Mercenaries to compleat the works of death, desolation and tyranny, already begun with circumstances of Cruelty and perfidy scarcely paralleled in the most barbarous ages, and totally unworthy the Head of a civilized nation.

He has constrained our fellow Citizens to violate and destroy the inalienable rights stated herein of other People.

He has excited domestic insurrections amongst us, and has endeavoured to bring on the inhabitants of our frontiers a complete destruction of all People who will not submit to His leadership.

Since his Election, the People have tried to petition for redress in all available avenues known to them. Our repeated attempts have been answered only by repeated injury. A President whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a Free People.

We are reminded of the circumstances of our emigration and settlement here and our past history since the original Declaration of Independence. We have voted and will perhaps now try the Justice System. We will appeal to their native justice and magnanimity, and we conjure them by the ties of our common kindred to disavow these usurpations, which, would inevitably interrupt our connections and correspondence. They may too be deaf to the voice of justice and of consanguinity. We must, therefore, acquiesce in the necessity, which denounces our Separation, and hold MR. GEORGE W. BUSH, as separate from me.

I, therefore, being me, a human being on planet earth, appealing to no one, but notifying all, of my intention, do, solemnly publish and declare, that this Person is free and that all political connection between me and the United States of America is and ought to be totally dissolved; and that as a Free and Independent Person, I have full power to live in Peace, contract Alliances, establish Commerce, and to do all other Acts and Things which Independent States and People may of right do. And for the support of this Declaration, with a firm reliance on the protection of divine Providence, I mutually pledge to any other Person, my Fortune and my sacred Honor.

The signers of the Declaration represented the new, free Person of the United States of America as follows:
